In order to download any sounds from the MBYC Sound Library or any music from the MBYC website, please read the Customer/ Licensing Agreement. You must accept this agreement if you want to buy music and download sounds. Once you have accepted it, you are bound to this agreement.
1.)MBYC Sound Library and music is royalty-free, meaning the purchasing price includes all licensing and usage fees.
2.) The term “sound” or “sounds” in this document, refers to any sound, sample or file, in any format or configuration, that comes from the MBYC database or any MBYC product, including but not limited to: Audio CD’s, CD-ROMs, mixed mode CDRs. 3.) All sounds remain property of MBYC (named the licensor), and all downloaded sounds are licensed, not sold to the registered user (named the licensee). All rights not expressly attributed to the registered user are reserved by MBYC.
4.) The registered user is getting a single user license, which is not transferable. This means only the registered user can have the sounds for personal use or incorporated into or modify them for to be used in software applications, media presentations, corporate or other training, stage/drama productions, different soundtracks, musical compositions commercial A/V production, Television, Radio, Film and Broadcasts, Web design, Multimedia and DVD Presentations, computer games, music on hold and ring tones, etc. according to this agreement.
5.) If the production containing the music is made commercially available for sale to the public, an additional license is needed if the total amount of products manufactured/ downloads exceeds 2500 units. You can purchase the additional licenses here.
6.) In case your work containing our music is broadcasted (radio, film, television, cable), you must report music usage information to your performing rights organization (ASCAP, BMI, PRS, SOCAN, ADA , SESAC, ASCAP, BMI) by filling out a cue sheet. In this manner the creators will receive their rights and you will use it legally and law protected by any improper claims. If authorship is mentioned in your titles, credits, cue sheets or elsewhere, it must be under the name of MBYC.
7.) Multi-user license can be purchased or granted only with written consent of MBYC.
8.) It is completely prohibited to copy, trade, lend, resell any of these sounds, and also to re-distribute as your own work, or assign duplicates to any third party. These sounds may not be sold as a stand-alone product, cannot be used to create a new sound library in a database or on any form of media such as CD-ROM, CDA, DVD, DVD-R, any form of magnetic or optical storage media. Any of these will be considered a violation of the copyright laws and an inappropriate use according to this agreement.
9.) You can not share or transfer the sound files electronically or through any file sharing program, FTP site, service bureau operation, DRS, computer network or in any way, except clearly expressed in written by MBYC.
10.) Any recording of the streamed demos or sounds to or from any playback or recording device, computer, or any form of audio or video equipment, is strictly prohibited. Any kind of recording made of a sound from the MBYC Sound Library, internet site or MBYC products by any way, is a duplicate and not a new sound and is prohibited by the terms of this agreement. 11.) When creating music intended for commercial use, the sounds from the MBYC database or any MBYC product may only be used “in combination” with other sounds from or any other source in order to create a new composition, in accordance with this agreement, and not as a stand- alone sound.
